Understand Deferred Action For Dreamers Program

By Molly Morse

Deferred action for dreamers offers administration relief or temporary permission to stay in United States for unregistered youths. These are persons who migrated to the country as children and are therefore not documented. The temporary permission expires after two years and can be renewed. An individual with this permission can apply and be granted employment authorization. Evaluations are done on a case to case basis.

The DHS/Department of Homeland Security runs the program. There are specialist advocates with adequate and accurate resources to advice applicants. The department advices individuals against seeking assistance from any notary public or immigration consultant since each case is unique and requires specialized approach. They have information on the approved lawyers and their location. This information is available online. It is the DHS that holds power to approve or decline an application.

There is no guarantee that persons who have been granted temporary permits will automatically qualify for lawful permanent status or US citizenship. This is only recognition of legal stay in the US as long as the permission is still valid. The status is granted to persons who have fulfilled certain requirements as set by the DHS.

For a person to qualify, he or she must have been born on 16th June 1981 or later. Other eligible persons are those who went to the US before they were 16 years old. A person who has been in the US since June 15th 2007 without any break is eligible. People whose immigration documents have expired can apply for the temporary permit alongside those who have been living without papers.

The eligibility criterion covers high school graduates and persons with GED certificate-General Education Development. Other categories covered under the program are discharged soldiers from the US armed force and Coast Guards. Criminal records like involvement in felony or conviction for significant misdemeanor will lead to disqualification. The applicant should not have been involved with criminal gangs or related activities.

The DHS carries out a thorough background check to establish the biometric and biographic data that is available about the person. Proof of qualification includes such documents as financial records, medical records and school documents. Employment and military records are part of the proof that will be used to qualify a person. Document that show continued say in the US are at time substituted with a sworn affidavit by at least two persons who were in the US for the required period and who know you well.

Persons who have been arrested for any offense are required to get a copy of their arrest history from the FBI. The decision of the court on your case should also be attached. The letter on judgment is usually referred to a disposition certificate. When the deferred action is renewed, a person is required to reapply for a work permit. Different states have varied requirement before granting driving licenses to dreamers.

The approval of deferred action for dreamers takes approximately six months but varies depending on the circumstances in each case. One can use the permit to travel away from US for such commitments as education, employment or to assist in humanitarian missions. Special circumstances are granted waivers while the others have to pay the full amount for approval. The fees include charges for finger printing as well as authorization for employment.
